Terms of Service

1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and Purgit, Inc. ("Purgit," "we," "us," or "our"), a Delaware corporation, governing your access to and use of the Purgit website, application, API, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
2. Eligibility
You must be at least 18 years of age, or the age of majority in your jurisdiction, to use Purgit. If you are under 18, you may use Purgit only with the involvement and consent of a parent or legal guardian. By using Purgit on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms, and "you" and "your" will refer to both you individually and the entity you represent.
3. Account Registration
To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at security@purgit.io if you suspect any unauthorized access to or use of your account.
4. Services Description
Purgit provides document metadata scanning, sanitization, and verification services designed to help professionals identify and remove hidden metadata from files before sharing. The Service inspects documents for embedded metadata, offers tools to remove or anonymize that metadata, and verifies the results through a rescan process. We offer Free, Pro, and Team subscription tiers, each with different capabilities and usage limits, as described on our pricing page at purgit.io/pricing.
5. Permitted Use
You may use Purgit to:
- Scan your own documents for hidden metadata before sharing them with others;
- Remove or anonymize document metadata using our sanitization tools;
- Verify that sanitized documents are free of targeted metadata through our rescan and report features;
- Integrate Purgit into your workflows via our API, subject to the rate limits and usage terms of your subscription tier.
6. Prohibited Use
You may NOT use Purgit to:
- Upload malware, viruses, or files specifically designed to exploit vulnerabilities in or cause harm to our systems or infrastructure;
- Attempt to extract, harvest, or access copyrighted content from documents belonging to others without authorization;
- Circumvent legal discovery obligations, spoliate evidence, or otherwise use the Service to obstruct legal proceedings or regulatory investigations;
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of our software, except as permitted by applicable law;
- Use the API or Service to build, train, or operate a competing metadata removal, scanning, or sanitization service;
- Exceed rate limits through credential sharing, automated scripting beyond authorized API use, or any other means designed to circumvent usage restrictions;
- Upload content that infringes on third-party intellectual property rights, contains illegal material, or violates any applicable law or regulation.
7. File Processing and Data
You retain full ownership of all files you upload to or process through Purgit. We claim no intellectual property rights in your content. By uploading a file, you grant Purgit a limited, temporary, non-exclusive license to process the file solely for the purpose of providing the scanning, sanitization, and verification services you requested. This license terminates automatically when processing is complete and the file is deleted from our systems. 8. Subscriptions and Billing
- Subscription fees: Paid subscriptions are billed monthly or annually in advance via Stripe, our payment processor. Annual plans are billed as a single upfront payment. Monthly plans are billed on the same date each month.
- Pro-rated upgrades: If you upgrade your subscription mid-billing cycle, you will be charged the pro-rated difference for the remainder of the current billing period.
- Refund policy: New subscribers are eligible for a full refund within 7 days of their first subscription purchase. No refunds are issued after the 7-day period, for subscription renewals, or for one-time document credits that have been used.
- Cancellation: You may cancel your subscription at any time. Upon cancellation, you will retain access to paid features through the end of your current billing period. No partial refunds are provided for unused time.
- Free tier: The free tier is subject to rate limits, currently set at 3 scans per day. We reserve the right to modify free tier limits with 30 days advance notice.
9. API Usage
If you access Purgit through our API, the following additional terms apply:
- API keys are confidential credentials. You must not share them publicly, embed them in client-side code, or commit them to public repositories.
- All automated usage of the Service must respect the rate limits associated with your subscription tier.
- We reserve the right to throttle, rate-limit, or temporarily suspend API access that degrades service quality or availability for other users.
- Abuse of the API, including but not limited to circumventing rate limits or using multiple accounts to increase capacity, may result in immediate suspension of access.
10. Intellectual Property
The Purgit name, the Purgit shield mark, and all related logos, product names, and service names are trademarks of Purgit, Inc. Our software, website, documentation, and all associated content are protected by copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding without prior written permission from Purgit, Inc. Nothing in these Terms grants you any right, title, or interest in or to our intellectual property.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT PURGIT WILL DETECT OR REMOVE ALL METADATA FROM EVERY FILE FORMAT OR CONFIGURATION. YOU SHOULD ALWAYS REVIEW THE SCAN REPORT AND INDEPENDENTLY VERIFY RESULTS BEFORE SHARING SENSITIVE DOCUMENTS. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PURGIT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE. PURGIT'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES YOU PAID TO PURGIT IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless Purgit, Inc. and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your infringement of any third-party intellectual property or other rights.
14. Termination
We may suspend or terminate your account and access to the Service immediately and without prior notice if you violate these Terms or engage in conduct that we reasonably determine to be harmful to the Service, other users, or Purgit. For accounts in good standing, we will provide at least 30 days notice before any discretionary termination. Extended free-tier abuse, including but not limited to creating multiple accounts to circumvent usage limits, may result in account suspension. You may cancel your account and stop using the Service at any time. Upon termination, your right to use the Service ceases immediately, and we may delete your account data in accordance with our Privacy Policy.
15. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. Arbitration shall take place in Delaware. Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits. You agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class action, collective action, or representative proceeding.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days advance notice via email to the address associated with your account and through an in-app notification. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of those changes. If you do not agree with the revised Terms, you must stop using the Service before they take effect.
